Chapter 1. General Provisions

Article 1 (Purpose)

These Terms set out the rights, obligations and responsibilities of DaVal Co., Ltd. (주식회사 데벨, the "Company") and its members, and other necessary matters, in connection with the use of the mobile application "Vibe Bible" and the services that come with it (the "Service") provided by the Company.

Article 2 (Definitions)

  1. "Service" means the following features that the Company provides through its iOS and Android applications.
    • Bible reading: reading the full text of the Bible — the Berean Standard Bible (BSB) in English and the New Korean Revised Version (개역개정) in Korean. It is free whether or not you subscribe.
    • Today's Verse: suggests one verse and a short reflection each day. For members who are subscribed and have completed their profile, artificial intelligence chooses them to fit the profile; for other members, they are suggested from a list of verses the Company has chosen in advance. This includes Lock Screen and Home Screen widgets.
    • Counsel: based on the concern a member writes, artificial intelligence finds Bible passages and puts together a pastoral interpretation.
    The Service can be used in English or Korean. By default it follows the language of the member's device, and the member can change it in the app.
  2. "Member" means a person who has agreed to these Terms and entered into a service agreement by signing in with an Apple or Google account.
  3. "Free Services" means services used without payment, and "Paid Services" means services used for a fee.
  4. "Subscription" means a pass for the Paid Services that renews automatically every month through recurring billing in the Apple App Store or Google Play (each a "Store").
  5. "Counsel Output" means all Scripture quotations, interpretations and guidance text that the counsel feature generates in response to a member's input.

Article 3 (Posting and Amendment of the Terms)

  1. The Company posts these Terms in My Page in the app and on the Company's website.
  2. The Company may amend these Terms to the extent that doing so does not violate applicable laws. When it does, it will announce the effective date and the reasons for the amendment starting 7 days before the effective date. Amendments that are unfavorable to members will be announced starting 30 days in advance, and members will be notified individually by in-app notice or email.
  3. If a member keeps using the Service without clearly objecting by the announced effective date, the member is deemed to have agreed to the amended Terms. A member who does not agree to the amended Terms may terminate the service agreement (delete their account).

Article 4 (Company's Obligations)

  1. The Company complies with applicable laws and these Terms, and strives to provide the Service continuously and reliably.
  2. The Company protects members' personal information in accordance with the Privacy Policy.
  3. The Company clearly shows the content and price of the Paid Services, and how to pay, renew and cancel, on the payment screen and in these Terms.
  4. The Company handles members' legitimate opinions and complaints promptly. When it is difficult to resolve one, the Company tells the member why and when it expects to respond.

Article 5 (Members' Obligations)

  1. Members must comply with these Terms, applicable laws and the Company's notices, and must not do any of the following:
    • use another person's Apple or Google account, or sign up using another person's information;
    • interfere with the normal operation of the Service, or access the Service by automated means;
    • reverse engineer, decrypt or modify the app, or copy, distribute or transmit any part of the Service without permission;
    • provide or sell Counsel Output or curated content to third parties for commercial purposes;
    • create multiple accounts to improperly and repeatedly use benefits such as the free counsel;
    • enter or post content that infringes the rights of others or violates the law.
  2. Members are responsible for managing their own Apple or Google account and device, and bear any disadvantage caused by failing to do so.
  3. Members should not enter other people's personal information (such as real names or contact details) into the counsel feature unless it is necessary.

Article 6 (Intellectual Property)

  1. Copyright and other intellectual property rights in the Service — including the app, source code, design, trademarks, curated verse lists and reflection texts, and the counsel pipeline — belong to the Company. Members have only a non-exclusive, non-transferable right to use them for the purpose of using the Service.
  2. The Korean Bible text provided in the Service is the New Korean Revised Version (개역개정), and its copyright belongs to the Korean Bible Society. Members may use that text only for personal, non-commercial purposes; mass copying and redistribution are not permitted. The English Bible text is the Berean Standard Bible (BSB), which has been in the public domain since April 30, 2023.
  3. Members may freely use Counsel Output for personal, non-commercial purposes. Copyright in the concerns a member writes belongs to the member, and the Company handles them only within the scope of Article 13.
  4. The Company may update the app to fix errors, improve performance or add features.

Article 7 (Limitation of the Company's Liability)

  1. The Company does not guarantee the completeness, accuracy or appropriateness of the information the Service provides, in particular Counsel Output. Responsibility for interpreting Counsel Output and for decisions based on it lies with the member (Article 12).
  2. The Company is not liable for damages arising from causes beyond its reasonable control, such as natural disasters, telecommunications network failures, or outages of third-party services including the Stores and artificial intelligence model providers.
  3. Unless applicable laws specifically provide otherwise, the Company is not liable for damages caused by reasons attributable to the member, or for damages arising in connection with the use of the Free Services.
  4. Payments and refunds are handled by the Stores. Payment problems caused by a Store are governed by that Store's policies and procedures.

Chapter 2. Service Agreement

Article 8 (Formation of the Service Agreement)

  1. The service agreement is formed when a person who wishes to become a member agrees to these Terms and the Privacy Policy and signs in with an Apple or Google account. The Company creates the account with the email and identifier passed on by the sign-in provider, and does not create or store a separate username or password.
  2. Persons under the age of 14 may not sign up as members.
  3. The Company may refuse a sign-up, or later terminate the service agreement, in the following cases: use of another person's account; where the person has previously been restricted from using the Service for violating these Terms; and any other case in which serious disruption to the operation of the Service is expected.
  4. Entering a profile (the name you'd like to be called, birth year, gender, occupation, life stage, marital status, faith stage and concerns) is optional. Except for the name, profile items can be entered only by subscribed members. The information entered is used only for Today's Verse recommendations and counsel, and can be edited or deleted at any time in My Page. When a subscription ends, the profile already entered remains, and it can always be deleted.

Article 9 (Accounts and Devices)

  1. An account stays signed in on only one device at a time. If you sign in to the same account on another device, the previous device is signed out automatically and is told that this has happened.
  2. An Apple account and a Google account are treated as different members even if they have the same email address. The Company does not merge the two accounts without the member's explicit request.
  3. If a member deletes their account, they may sign up again with the same Apple or Google account, but they will be treated as a new member and their previous records will not be restored.

Article 10 (Paid Services — Subscription)

  1. The first counsel for each account is provided without a subscription. From the second counsel on, a subscription is required. Entering a profile (other than the name) and Today's Verse recommendations fitted to the profile are also part of the subscription. Bible reading is free regardless of subscription.
  2. In Korea, the subscription costs KRW 9,900 per month (VAT included). In other countries and regions, the price and currency shown by the Store apply. Members subscribing for the first time get the first month free as the Store's introductory offer. When the free period ends, the first payment is made automatically unless the subscription is cancelled, and it then renews automatically every month.
  3. Payments are processed by the Store using the payment method registered to the member's Apple ID or Google account. The Company does not collect or store payment method information such as card numbers.
  4. The Company may change the subscription price when needed for operational or technical reasons. Price changes are announced in advance through the Store's procedures and do not apply retroactively to periods already paid for.
  5. Access to the subscription opens once the Company has confirmed the payment with the Store. If confirmation is delayed because of a Store outage or similar problem, the Company retries automatically until the payment is confirmed, and the member can ask for immediate confirmation with "Restore Purchases" in My Page or on the payment screen.

Article 11 (Cancellation and Refunds)

  1. Subscriptions are cancelled in the Store. On iOS, cancel in Settings › Apple Account › Subscriptions; on Android, cancel in Google Play › Subscriptions. Deleting the app or deleting your account does not by itself stop the Store's recurring billing.
  2. Cancellation takes effect at the end of the current billing period, and the member can keep using the Paid Services until then. If you cancel during the free period, you will not be charged.
  3. Refunds follow the Store's refund policies and procedures (Apple's "Report a Problem" and Google Play's refund request). The Company has no authority to cancel or refund Store payments directly; if a member asks for a refund, the Company will explain the Store's procedure.
  4. Even if the Company restricts a member's use because the member violated these Terms, fees for periods already paid for are not refunded. However, where applicable law requires a refund, the law will be followed.

Article 12 (Nature and Limits of the Counsel Service)

  1. Counsel Output is pastoral guidance generated by an artificial intelligence language model based on the text of the Bible. The Company verifies that quoted Bible verses match the source text exactly — character by character against the New Korean Revised Version in Korean, and word for word against the Berean Standard Bible in English. However, the interpretation and guidance are generated by the model and may contain errors or inappropriate expressions.
  2. Counsel Output is not professional advice about medical, mental health, legal, financial or career matters, and it does not replace such advice. Members should talk with an appropriate professional before making important decisions.
  3. If signs of crisis such as self-harm or suicide are detected in what a member writes, the Service shows contacts where the member can get urgent help instead of regular counsel. In Korean, these are the Suicide Prevention Counseling Line 109, the Mental Health Crisis Counseling Line 1577-0199, and 112 or 119 in an emergency. In English, the contacts shown depend on the member's region (the region set on the device and the country of the internet connection) and come from a fixed list of resources that the Company has checked against their official sources; they are never generated by the model. The Service also always shows an international directory of helplines and asks the member to call their local emergency number, so that a member whose region is not on the list, or unknown, still sees where to turn. The Service is not a crisis intervention organization and does not guarantee a real-time response.
  4. The Company states that the theological positions in Counsel Output do not represent the official position of any particular denomination or church.
  5. The number of counsels may be limited to prevent abuse (currently 10 per hour and 30 per day).

Article 13 (Handling of Counsel Data)

  1. What a member writes for counsel is sent to and processed by an artificial intelligence model provider (Anthropic PBC, United States) to generate Counsel Output. Neither the Company nor the model provider uses this data to train artificial intelligence models. For details, see the international transfer section of the Privacy Policy.
  2. The Company keeps the text entered and the resulting output on its servers so that members can see their counsel history again. When a member deletes their account, their counsel records are deleted without delay.
  3. For the safety of the Service, the Company may have a person review Counsel Output that has a high risk level or that failed verification. This review is limited to service quality and safety purposes.
  4. Today's notes (reflection memos), bookmarks and reading position are stored only on the member's device and are not sent to the server.

Article 14 (Restriction of Use)

  1. If a member violates Article 5, is found to be under the age of 14, or violates the law, the Company may restrict the member's use of the Service or terminate the service agreement without prior notice.
  2. When the Company restricts use, it tells the member the reason, the period and how to object. Once the reason has been resolved, the restriction is lifted without delay.

Article 15 (Changes to and Suspension of the Service)

  1. The Service is in principle provided 24 hours a day, all year round, but it may be suspended temporarily for system maintenance, outages, or circumstances of artificial intelligence model providers, the Stores or hosting providers. The Company announces this in advance where possible, and afterward when it is unavoidable.
  2. The Company may change or discontinue some features of the Service (for example, the model used, how verses are curated, or widgets). If there is a significant change to the Paid Services, notice is given through the procedure in Article 3.
  3. If the Company ends the Service entirely, it will announce this at least 30 days in advance, and will explain how to obtain a refund through the Store's procedures for any part of a paid period that could not be provided.

Article 16 (Account Deletion)

  1. Members may terminate the service agreement at any time with "Delete Account" in My Page, and the Company processes it immediately.
  2. When an account is deleted, the profile, counsel records and sign-in connection information are deleted immediately, and for Sign in with Apple accounts, Apple is also notified to disconnect the account. Payment records are kept as required by applicable law (see the Privacy Policy).
  3. Deleting your account does not automatically cancel the Store's recurring billing. Subscribed members must cancel separately in the Store, as described in Article 11.

Chapter 3. Miscellaneous

Article 17 (Effect of the Terms)

These Terms take effect when a member agrees to them and signs in. For existing members, amended Terms take effect from the effective date announced under Article 3.

Article 18 (Matters Not Covered by These Terms)

Matters not set out in these Terms are governed by the usage guides announced by the Company, applicable laws (such as the Act on the Consumer Protection in Electronic Commerce, the Content Industry Promotion Act and the Personal Information Protection Act of Korea) and commercial practice. For matters concerning payments and refunds, the rules of the Apple App Store and Google Play take precedence.

Article 19 (Notices to Members)

The Company gives notice to members by one or more of the following: the email linked to the member's sign-in account, in-app notifications, or posting on the Company's website. Notices to all members may be given by posting on the website.

Article 20 (Disclaimer)

  1. Liability arising from a member's unlawful acts or violation of these Terms lies with the member. If the Company receives a claim for damages from a third party as a result, the member must indemnify the Company.
  2. The Company is not responsible for faith-related or personal decisions that members make based on Counsel Output or Today's Verse, or for the results of those decisions.
  3. The Company has no obligation to intervene in disputes that arise through the Service between members, or between a member and a third party.
  4. Unless the Company acted intentionally or with gross negligence, the Company's liability for damages does not exceed the total fees the member paid the Company during the 6 months immediately before the damage occurred. This clause applies only to the extent permitted by applicable law.

Article 21 (Dispute Resolution)

  1. The Company and members will make efforts to resolve disputes about the Service amicably. Members can contact the Company at business@daval.ai.
  2. These Terms are governed by and interpreted under the laws of the Republic of Korea, and any lawsuit shall be filed with the court that has jurisdiction under the Civil Procedure Act of Korea.
  3. Members may apply for relief to the Korea Consumer Agency, the Korea Fair Trade Commission, or a dispute mediation body commissioned by a mayor or provincial governor.
